If the trustee has powers to decide who does or does not have access to the data, then trust law is not likely to help with enforcement. It seems like in the short term, data trusts will have to be data trust-like consortium arrangements instead of an actual trust. Still valuable, and maybe models can be developed and incentivized by government by some future legislation.
